Terms of service
Who this is between
These terms are the agreement between you and us. Using the service means you accept them. If you are agreeing on behalf of an employer or a school, you are confirming you are allowed to.
Your account
You need to be at least 13 to hold an account. If you are under 18, you need a parent, guardian or school to agree to these terms for you.
Keep your password to yourself. What happens under your account is your responsibility, so tell us through the help page if you think somebody else is in it.
Answering a survey
Anyone can answer a survey without an account, and we do not set an age limit on answering. The person who made the survey decides who they send it to and is responsible for asking appropriately. If they are surveying children, that is their call and their duty of care, and their own rules apply.
What you may not do
Do not use FreeSurvey to break the law, to harass anybody, to send spam, or to collect information from people by pretending to be someone else. Do not use it to gather payment card numbers, health records, government identifiers or anything else that needs handling we do not offer.
Do not try to break the service, get into accounts that are not yours, or put load on it beyond ordinary use.
Who owns what
Your surveys and the answers people give you are yours. We do not claim ownership of them. You give us only the permission we need to store them, show them back to you, and run the features you switch on.
FreeSurvey itself, the software and the brand, stays ours.
The answers people give you
You decide what to ask, who to ask, and what to do with the replies. That makes you responsible for those answers under data protection law, and us responsible for holding them safely on your behalf. What we hold and why is set out in the privacy policy.
Stopping
You can close your account at any time from your settings. We can suspend or close an account that breaks these terms, and we will tell you why unless the law stops us.
What we do and do not promise
We work to keep FreeSurvey running and to fix what breaks, but we do not promise it will never be unavailable, and we do not guarantee a particular uptime. The service is provided as it is.
Keep your own copy of anything you cannot afford to lose. You can export your results at any time.
Where our responsibility ends
We are not liable for lost profits, lost data or indirect losses. Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim. Nothing here removes a liability that cannot legally be removed.
Changes
If these terms change in a way that affects you, we will say so on this page and email account owners. The date at the top is the last change. Carrying on using the service after that means you accept the new version.
Which law applies
These terms are governed by the law of the State of Georgia, in the United States. Disputes go to the state or federal courts serving Hall County, Georgia, and both sides agree to that. If you deal with us as a consumer somewhere else, you keep whatever rights your own country gives you.
Reaching us
Everything goes through the help page, including questions about these terms, about billing, and about your data.
Your surveys and your answers are yours. We just hold them.
Paid plans renew until you stop them. Cancel whenever, no refunds, and you keep the time you bought.
Do not use it to break the law or to bother people.
